ESP holds to the highest industry standards and has no tolerance for spam or non permission based email communication.

Definition of Spam

Spam is unsolicited email is also known as junk or UCE (Unsolicited Commercial Email). By sending email to only to those who have requested to receive it, you are following accepted permission-based email guidelines. Email sent to purchased lists, presumed affiliate acquaintance, data partnerships, or indirect subscription services is generally considered to be spam.

ESP Complaint Procedures – List Owner, Email Recipient, Blacklist Owner, or ISP

Whether you are an ESP customer, list owner, an email recipient, a blacklist owner, ISP, or mail administrator we take all complaints seriously. ESP understands its responsibility to its customers and their subscribers to provide honest communication. Please email all concerns, or comments, to: abuse@emailsynergy.com.

Policy – For Users of ESP

You may only use ESP to send email to those who have “consented” to receive email from you. “Consent” is usually acquired via an “opt-in.” A valid opt-in must disclose what will be sent and how often it will be sent. You may not use ESP to send email to anyone who has not given you “consent” to receive such email.

Specifically, you may not use ESP to do any of the following:

  • Send e-mails to people who have not affirmatively agreed to receive such e-mails or people who have opted out or unsubscribed to your mailing lists;
  • Send e-mails unrelated to the purpose for which the consent was initially received;
  • Send e-mails with misleading or deceptive subjects;
  • Send e-mails with false or misleading header information (i.e., “to,” “from” and routing information);
  • Send e-mails based on any lists you purchased or otherwise obtained from a third party, regardless of whether such third party obtained consent or not;
  • Create more than one account for yourself or for your business;
  • Harvest or otherwise gather email addresses;
  • Impersonate any other person, real or fictitious, or otherwise misrepresent yourself or your organization; or
  • Send e-mails or use the Service not in compliance with the CAN-SPAM Act or any other relevant privacy or consumer rules, regulations, or laws.

ESP takes the following measures, among others, to prohibit its users from sending spam:

- Monitoring email distributions of all sizes made through ESP for violations of our policies;
- Prohibiting email to those who have previously opted-out of receiving email from a given sender;
- Prohibiting the use of the ESP entirely by those who either send spam or violate the ESP Terms of Use;
- Embedding unsubscribe links in each email;
- Flagging for our users specific email content that could lead to an email being considered to be spam; and
- Educating end users about “best practices” for email and digital communications.
